Filing for divorce in Terrell County

1. CONSULT AN ATTORNEY
Divorce can be a difficult and complicated process. We strongly recommend that EVERYONE considering filing for divorce consult and/or hire an attorney before filing any paperwork regarding divorce. The Clerk may not answer any questions regarding legal decisions, including helping you select and/or complete your paperwork. Paperwork for uncontested divorce proceedings can be found at the Pataula Judicial Circuit website. The forms and instructions have been prepared by qualified professionals and should be relatively easy to understand and complete. If you have any problems or questions regarding the forms you should consult an attorney.
2. FEES: 
FILING FEE: $215.00. This fee must be paid at the time of filing.
SERVICE FEE: $50.00 The Service fee is required for the Sheriff to serve your Complaint for Divorce to your spouse. Service fees must be paid at the time of filing. This is required unless your spouse signs and has notorized the ACKNOWLEGEMENT OF SERVICE form found on the forms website. 
3. E-Filing:
Beginning in 2019, the State of Georgia began requiring civil cases to be electronically filed. The Terrell County Superior Court Clerk's Office uses Peachcourt.com to e-file civil cases. 
Your divorce case will need to be efiled through this secure website. You CAN file from any computer, at any time of day, or you may make an appointment to use the Public Access Terminal in the Clerk's Office to efile your case. Peachcourt does require a small fee to use their website for filing if you use your personal computer. If you would like to bypass the website fees, you must use the Public Access Terminal in the Clerk's Office. FILING FEES are separate from website fees and CANNOT BE WAIVED by using the Public Access Terminal.
4. If you choose to file without the assistance of an attorney, (Pro se,) you will need to select your paperwork from the forms provided on the Patuala Judicial Circuit website. PLEASE read the SELF HELP GUIDE provided ((link highlighted in red.) You will need to carefully follow the instructions provided (link highlighted in red.) You will need to carefully follow the checklist (link highlighted in red.)
If you do not understand the directions, or do not see the necessary forms, you MUST contact an attorney for advice. The clerk may NOT answer legal questions.

Filing for a name change

We strongly recommend that EVERYONE considering filing for a name change consult and/or hire an attorney before filing any paperwork. The Clerk may not answer any questions regarding legal decisions, including helping you select and/or complete your paperwork. Paperwork for name changes for both adults and minors can be found at the Pataula Judicial Circuit website. The forms and instructions have been prepared by qualified professionals and should be relatively easy to understand and complete. If you have any problems or questions regarding the forms you should consult an attorney.
